General Terms and Conditions (GTC)

1. Scope

These General Terms and Conditions (GTC) apply to all contracts, deliveries and services provided via the webshop of

MT Goldberg – Maschinen GmbH
Stockenboi 4, 9714 Stockenboi, Austria

a contract is concluded between MT Goldberg – Maschinen GmbH (hereinafter referred to as “Seller”) and the customer.

Any differing terms and conditions of the customer will not be recognized unless they have been expressly agreed to in writing.

2. Conclusion of the contract

The products displayed in the webshop do not constitute a legally binding offer, but rather a non-binding invitation to place an order.

The contract is concluded as soon as the seller accepts the customer's order by sending an order confirmation via email or dispatches the goods.

3. Prices and shipping costs

All prices quoted are in euros and include statutory VAT , unless otherwise stated.

Shipping costs may apply in addition to the prices shown. These will be clearly displayed to the customer before the order process is completed.

4. Payment

The following payment methods are available – depending on the selection in the webshop:

  • prepayment

  • credit card

  • Online payment services

  • other payment methods listed in the webshop

The purchase price is due immediately unless otherwise agreed.

5. Delivery and Shipping

Delivery will be made to the delivery address specified by the customer.

Delivery times are non-binding unless they have been expressly agreed upon in writing as binding.
Partial deliveries are permitted, provided they are reasonable for the customer.

6. Retention of title

The goods remain the property of MT Goldberg – Maschinen GmbH until the purchase price has been paid in full.

7. Right of withdrawal for consumers

Consumers, as defined by the Consumer Protection Act, have a right of withdrawal of 14 days .

The cancellation period begins on the day on which the customer or a third party designated by him has taken possession of the goods.

To exercise the right of withdrawal, the customer must inform the seller of his decision by means of a clear statement (e.g. by e-mail).

The customer bears the return shipping costs unless otherwise agreed.

8. Exclusion of the right of withdrawal

No right of withdrawal exists in particular in the following cases:

  • Goods that are manufactured according to customer specifications

  • individually configured or specially ordered machines

9. Warranty

The statutory warranty provisions apply.

For entrepreneurs, the warranty period is 12 months from the date of delivery of the goods.
Consumers are subject to the statutory warranty period.

10. Liability

The seller is only liable for damages resulting from intent or gross negligence .

Liability for slight negligence is excluded, except in cases of personal injury.

11. Warranty

Any guarantees only exist if they have been expressly assured in writing.
Statutory warranty rights remain unaffected.

12. Data protection

Information on the processing of personal data can be found in the privacy policy on the website.

13. Contract language

The contract language is German .

14. Jurisdiction and applicable law

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods.

The place of jurisdiction is – insofar as legally permissible – the competent court at the company's registered office.

15. Severability Clause

Should individual provisions of these terms and conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.

16. Final Provisions

Any changes or additions to these terms and conditions must be in writing.
